If the worker performs unlawful acts, is violent or jeopardizes the safety of other workforce, you have the right to layoff them immediately. If the complaints of poor job productivity turns out to be unclear or vague — or — if the employee has not been counseled about her job performance and given a chance to improve — then terminating a pregnant worker after finding out about the pregnancy will cause you trouble. A lack of honesty is the first warning sign of worker gross misconduct. If you suspect the worker might do something mischievous or damaging to firm property, you might have a security guard accompany them when they clean out their desk and to escort them from firm property. The poor performance could be the results of a drug or alcohol addiction. In the next chapter, we cover mass dismissals which are often easier for you than dealing with one disgruntled employee. Worker gross misconduct often takes the form of disrespectful outlook and behavior. Labor disputes can be costly in both your time and money, and a little planning during the lay off procedure is necessary. This will justify your actions and create an undisputable basis, as well as provide the employee with a way to get his act together for future jobs. Far too often employers lose on these claims simply because they failed to document the reasons on a termination suitably. All businesses need to have a jobholder manual.

Lastly, the most common mistake I hear is something like, "We terminated Joe because he just couldn't get the job done." You now know this isn't a layoff because you are not dimissing Joe because of a company need. If you're dismissing for an wrongful or stupid reason, is it worth it? First, the supervisor or the management should allow the worker a chance to make clear her or his behavior. Are you frustrated by a bad worker who is ruining the business' performance?
