It's a bitter pill to swallow and sends a bad message to your productive workforce, but sometimes it's the only action you can take. Dismissing such people may involve a security risk to your small business if they hold keys to buildings, file cabinets, or desks. If the jobholder is a hazard to any company and its employees (such as prone to violence or theft), then it's your duty to include this in your notification and phone references. If the manager chooses not to write the notification, a Personnel supervisor should do it. Fortunately, you have adequately detailed her inadequate performance. If your risk level is too high, you should compile enough documentation before terminating. During her employment, we promoted her from entry grade to Specialist 1. Including "The Reason" In The termination Notification. And don't document when you are sacking for an unlawful reason. Also you should document everything. Give 2 or 3 chances with formal warnings to increase before separating. For you, it stops a illegal dismissal suit and of paying a big settlement, right?

If you don't take action against the problem individual, this individual can quickly and easily cause your other workforce to become disgruntled. He'll get over it, and you'll soften the blow with a discontinuance package. He knows both you and the worker are not legal advisers and won't expect you to act like one.
